Level of Scrutiny Government Purpose Notes/Burden of Showing Discrimination
Strict Compelling Government must show that there is no other way to fulfill its the compelling purpose but for this law/discriminatory action.
Intermediate Important Government must show that there is an "exceedingly persuasive reason" for the discrimination.
Rational Basis Legitimate Must have a reasonable connection to a legitimate government purpose(1),(2).
(1)—To invalidate, the challenger must prove discrimination and discriminatory animus for the action.
(2)—The "reasonable" connection is incredibly lax/malleable.
