General Rule: Generally, incorporated provisions of the Bill of Rights may only be enforced against a "state actor."

  • Civil Rights Cases (1883): before the exception was recognized
    • The 14th Amendment does not apply to purely private conduct.
    • Private discrimination must be addressed under state tort/statutory law—not the Constitution.
